IMPORTANT NOTICE

Many Simon Motorsports products are designed for high-performance or racing applications and may not be legal for installation or use on pollution-controlled motor vehicles operated on public roads or highways. Certain products are intended for closed-course competition use only.

It is the purchaser’s responsibility to determine whether any product complies with all applicable federal, state, provincial, and local laws before purchasing or installing it. Installation or use of certain performance products on pollution-controlled vehicles may constitute tampering under applicable emissions regulations and may result in fines or penalties.

By purchasing or using Simon Motorsports products, you acknowledge and accept all responsibility for their proper installation, use, and legal compliance.

PAYMENT
Simon Motorsports accepts Visa, Mastercard, Discover, and American Express through our secure online payment system.
All credit card transactions are subject to fraud verification. Simon Motorsports reserves the right to refuse or cancel any order suspected of fraud or unauthorized use. Alternative payment methods may be accepted upon request. All products, machine work, and services must be paid in full before shipment or delivery.

PRICING
Prices are subject to change without prior notice. Although every effort is made to honor published pricing, supplier cost increases and material shortages occasionally require adjustments. Customers will always be notified of any price change before an order is completed.

ORDER CANCELLATIONS
Orders for in-stock products may be canceled prior to shipment. Orders containing custom-built, special-order, machined, or modified components cannot be canceled once work has begun.

SHIPPING
Domestic orders are shipped using FedEx, UPS, USPS, or another carrier selected by Simon Motorsports unless alternate arrangements are made in advance. Customers are responsible for all shipping charges. Shipping dates are estimates only and are not guaranteed. Simon Motorsports is not responsible for shipping delays caused by carriers, weather, customs, labor disputes, or events beyond our control.

INTERNATIONAL ORDERS
Customers are responsible for all shipping charges, customs duties, tariffs, VAT, brokerage fees, taxes, and any other import costs imposed by their country. These charges are not included in the purchase price unless specifically stated.

DAMAGED SHIPMENTS
Inspect all shipments immediately upon delivery. If damage is visible, note the damage with the carrier before accepting the shipment whenever possible. If concealed shipping damage is discovered after opening the package:
● Contact the freight carrier immediately.
● Retain all packaging materials.
● Notify Simon Motorsports as soon as possible.
We will gladly assist with the freight claim process.

REFUSED SHIPMENTS
Orders refused without prior authorization are subject to:
● A 20% restocking fee
● Original outbound freight charges
● Return freight charges

RETURNS
Customer satisfaction is extremely important to us. If you believe you have received an incorrect product:
STOP INSTALLATION IMMEDIATELY. Do not install, modify, or alter the product. Contact Simon Motorsports before proceeding. Products that have been installed, modified, damaged, altered, or used cannot be returned. Custom-built, back-cut, machined, modified, or  made-to-order products are non-refundable and non-returnable unless determined by Simon Motorsports to be defective in materials or workmanship. Approved returns require:
● A Return Authorization (RA)
● Original invoice
● Original packaging
● Product in new, resalable condition
● Prepaid and insured return shipping
Returns received without authorization may be refused.
Approved returns may be subject to a 20% restocking fee plus any original freight charges incurred by Simon Motorsports.

MACHINE SHOP SERVICES
Published machine shop pricing covers labor only.
Additional charges may apply if components require excessive cleaning, repair, inspection, or preparation before machining.
Previously modified components may not qualify for Simon Motorsports services.
Unless approved in advance, Simon Motorsports will only perform machining on components originally supplied by Simon Motorsports or previously purchased through Simon Motorsports.
Customers are responsible for shipping components clean and properly packaged.
Improperly packaged parts that become damaged during shipment remain the responsibility of the customer.

SHIPPING PARTS FOR MACHINE SHOP SERVICES
Before shipping parts:
● Complete the Simon Motorsports Job Order Sheet in full.
● Include complete contact information.
● Clearly describe the requested work.
● Clean components thoroughly.
● Wrap each part individually.
● Package all parts securely.
● Insure the shipment for full replacement value.
Improper packaging may void carrier damage claims. Current turnaround times vary depending on workload. Contact us for current estimated completion times.

TECHNICAL SUPPORT
Technical support is available only for products and services sold by Simon Motorsports.
Support requests should include:
● Customer name
● Phone number
● Invoice number
● Motorcycle year and model
● Complete list of engine and drivetrain modifications
● Simon Motorsports parts installed
Support may be requested by:
● Email
● Telephone
● WhatsApp (International Customers)
Please allow 24–72 business hours for a response.

LIMITED WARRANTY
Simon Motorsports warrants products manufactured by Simon Motorsports to be free from defects in materials and workmanship.
If a defect is determined by Simon Motorsports after inspection, we may, at our sole discretion:
● Repair the product
● Replace the product
● Issue another appropriate remedy

This warranty does not cover failures resulting from:
● Improper installation
● Improper break-in
● Abuse
● Neglect
● Improper maintenance
● Improper lubrication
● Overheating
● Detonation
● Racing
● Competition use
● Accidents
● Misuse
● Unauthorized modifications
● Powder coating
● Painting
● Polishing
● Chroming
● Disassembly
● Customer repairs
Products manufactured by other companies are covered solely by their respective manufacturer’s warranty.

RACING PRODUCT DISCLAIMER
Many Simon Motorsports products are intended for racing and high-performance applications.
Because racing places extraordinary stress on mechanical components:
NO WARRANTY OF ANY KIND IS PROVIDED ON PRODUCTS USED IN:
● Racing
● Competition
● Dyno testing
● Professional performance applications
● Any use beyond normal street operation
Use of these products is entirely at the customer’s own risk.

LIMITATION OF LIABILITY
Motorcycles and high-performance vehicles are inherently dangerous. By purchasing, installing, or using Simon Motorsports products, the customer assumes all risks associated with their installation and operation.
Simon Motorsports shall not be liable for:
● Personal injury
● Death
● Property damage
● Loss of vehicle use
● Lost income
● Lost profits
● Labor expenses
● Towing
● Rental expenses
● Incidental damages
● Consequential damages
● Special damages
To the fullest extent permitted by law, Simon Motorsports’ maximum liability shall never exceed the purchase price of the product involved. Some jurisdictions do not allow certain exclusions or limitations. Those limitations shall apply only to the extent permitted by law.

PRODUCT FITMENT
It is the customer’s responsibility to verify compatibility before ordering.
Motorcycles modified from factory specifications may require additional parts, machining, or custom fitting.
Simon Motorsports is not responsible for fitment issues resulting from aftermarket modifications.

INTELLECTUAL PROPERTY & TRADEMARKS
Harley-Davidson®, Harley®, H-D®, Screamin’ Eagle®, Twin Cam®, Sportster®, Softail®, Dyna®, Touring®, Milwaukee-Eight®, and all other Harley-Davidson model names and trademarks are the property of Harley-Davidson Motor Company. These trademarks are used solely for identification and reference purposes. Simon Motorsports is an independent company and is not affiliated with, endorsed by, or sponsored by Harley-Davidson Motor Company.

RIGHTS RESERVED
Simon Motorsports reserves the right to modify product designs, specifications, pricing, materials, availability, or these Terms and Conditions without prior notice.

GOVERNING LAW
These Terms and Conditions shall be governed by the laws of the State of North Carolina without regard to conflict of law principles.
Any legal action arising from the purchase or use of Simon Motorsports products or services shall be brought exclusively in the state or federal courts located within North Carolina.
